Terms and Conditions

By accessing or using TalentSage ("the Platform"), operated by VisionTact LLC ("we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not access or use the Platform. These terms apply to all users, including recruiters, hiring managers, administrators, and candidates who interact with TalentSage.

TalentSage is an AI-native Applicant Tracking System (ATS) and recruitment operating system that provides the following services: • AI-powered candidate evaluation across 7 dimensions (technical skills, relevant experience, education and qualifications, career trajectory, project and achievement evidence, role fit signals, and risk flags) • Skill Veracity program including Brain Tests (knowledge assessments) and Brain Tasks (practical assessments) • Resume parsing and structured data extraction • AI Matching Engine for candidate-to-job scoring • Automated email sequences, follow-ups, and candidate submissions • Client Portal for hiring manager collaboration • CRM module for client and agency management • Analytics dashboards, recruiter scorecards, and performance reporting • Chrome sourcing extension for profile capture • Job board integrations (50+) and AI Job Description generation • Role-based access control, audit logs, and compliance tools

To use TalentSage, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity. Enterprise accounts with SSO/SAML integration must comply with their organization's authentication policies.

TalentSage offers three subscription tiers: Freelancer, Growth, and Enterprise. Each plan includes specific allocations for AI Evaluation credits, Deep Dive credits, Brain Test/Task credits, AI Job Description credits, HR seats, and active job postings. • Monthly plans remain active until the end of the current billing period • Annual plans include a discounted rate (10% off Freelancer, 15% off Growth) • Annual plans are eligible for a 14-day refund window if fewer than 10 credits have been used • No cancellation fees apply to any plan • Enterprise pricing is custom and subject to a separate agreement • All prices are in USD unless otherwise stated

TalentSage uses artificial intelligence and deep learning to evaluate candidates. All AI evaluations are subject to the following: • PII (Personally Identifiable Information) including name, gender, address, and nationality is anonymized before any AI processing on every evaluation, on every plan • 8 bias-prevention rules are built in and active by default • All scores are backed by verbatim quotes from the candidate's CV or assessment submission • AI-generated scores are advisory and should be used alongside human judgment • TalentSage does not guarantee the accuracy of AI evaluations and is not liable for hiring decisions made based on AI scores

The Skill Veracity program includes integrity enforcement measures: • Brain Tests are monitored assessments. If a candidate switches tabs or leaves the test window, the assessment is automatically submitted • Brain Tasks unlock only when a candidate's Brain Test score meets the threshold set by the hiring team • Candidates are informed of these conditions before beginning any assessment • Assessment results are stored securely and accessible only to authorized HR personnel within the tenant organization

As a user of TalentSage, you agree to: • Use the Platform only for lawful recruitment and hiring purposes • Not upload or process data that violates any applicable laws or regulations • Not attempt to reverse-engineer, decompile, or extract source code from the Platform • Not use the Platform to discriminate against candidates on the basis of race, gender, religion, age, disability, or any other protected characteristic • Comply with all applicable data protection laws including GDPR, CCPA, and local employment regulations • Not share account credentials or allow unauthorized access to the Platform

All content, features, and functionality of TalentSage, including but not limited to software, algorithms, AI models, user interface design, logos, and documentation, are the exclusive property of VisionTact LLC and are protected by international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose during your active subscription.

You retain ownership of all data you upload to TalentSage, including candidate profiles, job descriptions, evaluation results, and communication records. You may request a full export of your data at any time. Upon account termination, your data will be retained for 30 days, after which it will be permanently deleted unless otherwise required by law.

To the maximum extent permitted by law, VisionTact LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of TalentSage. Our total liability for any claim arising from these terms shall not exceed the amount you paid for the Platform in the 12 months preceding the claim. TalentSage is provided "as is" without warranties of any kind, express or implied.

We may suspend or terminate your access to TalentSage at any time if you violate these terms, engage in fraudulent activity, or fail to pay subscription fees. You may cancel your subscription at any time through your account settings. Upon termination, your right to use the Platform ceases immediately, though certain provisions of these terms survive termination.

We reserve the right to modify these Terms and Conditions at any time. Material changes will be communicated via email or an in-app notification at least 30 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated terms.

These Terms and Conditions are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms shall be resolved through binding arbitration in accordance with applicable arbitration rules, unless otherwise agreed upon in an Enterprise agreement.
